Rule 4
Formation of Court of Inquiry
(1) According to rule 3, if the information related to the offense is received at the office of Prad Viwak or by any other means, if it is known that any offense has been committed by a person under the jurisdiction of the Act, such office shall recommend to the Commander-in-Chief for the formation of a Court of Inquiry.
(2) After receiving the recommendation according to sub-rule (1), the Commander-in-Chief may himself constitute a Court of Inquiry or, as required, appoint a Court of Inquiry by delegating authority to the Commander-in-Chief, Army Commander or Unit Commander.
(3) When forming a court of inquiry according to sub-rule (2), it shall not be constituted in such a way that its chairman or member is generally lower in rank than the accused person.
